ILS held its first meetingin 1996 with the goal of fostering the study of international law amongmembers of the Alabama State Bar and to educate the public about mattersconcerning international law. International law practitioners engagein the fields of private international law, international trade and commercialtransactions, international arbitration and dispute resolution, publicinternational law, bilateral and international treaties, and internationalhuman rights accords. But domestic practitioners engage in the fieldsof contractual agreements, construction, arbitration, insurance and liabilitymatters, taxation, admiralty law, Customs and Patents, intellectual property,constitutional law, immigration and nationality law, and civil law notarialservices, which have international components. ILShas been active in drafting legislation to implement the Civil Law NotariesAct and has cooperated with the National Association of Civil Law Notaries(NACLN) in arranging training for civil law notaries in Alabama and Florida. These two states are currently the only states that have passed legislationauthorizing their respective Secretaries of State to appoint civil lawnotaries. [CLICK HERE to go to "News"] Asthe Alabama economy becomes more integrated globally, it behooves us asinternational law practitioners to look for means to enable internationalbusiness transactions and to promote sound business practices. Asmore and more international companies come to Alabama, the Section's membershave been at the forefront of providing the necessary legal services requiredto make their transition to Alabama as easy as possible. Alabamafamily and criminal lawyers have come to find that, increasingly, thereare international aspects to their cases that did not exist a scant 10to 15 years ago. Families are sometimes split apart geographicallynot only by states, but by oceans and countries. Child support becomeshinged to international treaties. Criminals have never respectedborders; thus a criminal lawyer's practice can become increasingly internationalin scope. Admiralty lawyers are finding that their practices nowinvolve much more than shipments, Customs, and insurance. Afurther complication internationally is defining what the term "lawyer"means. Some nations divide their legal professions into an arrayof categories and branches. The legal traditions of some countries differsubstantially from others. In other countries, even the term "lawyer,"as it is understood in the United States, is unknown. The legal professionshave widely divergent requirements for education and training, as wellas for entrance examinations, around the world. For example, theUnited Kingdom requires law students to successfully complete three yearsof university training, while Spain and Portugal each require five. Postgraduate legal programs, which in most countries are normally offeredby the Bar and law societies -- not colleges and universities -- are focusedless on theoretical issues and more on the day-to-day questions a lawyermust face. The United Kingdom, for example, requires different educationalbackgrounds for each branch of the legal profession. Germany requiresat least two years of practical experience working for a prosecutor, afamily lawyer, a court, etc. And some countries do not require anytype of university law degree as a prerequisite to enter the legal profession. Theexplosive growth and prevalence of multinational corporations during thepast quarter century and the introduction of digital commerce during thepast 10 years have made the legal services provided by international lawyersmore vital to individuals, domestic and international business, and foreignstates. The International Law Section seeks to address the uniqueproblems that these two revolutions have brought to a rapidly expandingglobal economy.
