Judge Mason will take the seat formerly held by retired Judge Lillian J. Greene. August 13, 2008 in Cuyahoga Common Pleas | Permalink 2-Year SOL Applies in Ohio Section 1983 Actions Is it finally resolved once and for all? According to the Ohio Supreme Court's decision in Nadra v. Mbah, Case No. 2008-Ohio-3918, Ohio's 2-year personal injury statute of limitations contained in O.R.C. 2305.10 applies to civil rights actions brought under 42 U.S.C. sec. 1983. This opinion agreed with the trial court but not the Franklin County Court of Appeals, which had held that the plaintiff's claims were not barred because they were subject to the 4-year residual personal injury statute of limitations contained in O.R.C. sec. 2305.09(D). Justice Pfeifer's dissent envisions a 'Kiss Me Kate'' like situation where the majority court was convinced to believe that the sky was not blue in disregarding that a 2, rather than a 4-year statute of limitations was applicable. The underlying case arose when a mother whose children were removed from her custody sued 2 employees from Franklin County Childrens Services who were involved in the removal and a child-abuse complaint. August 13, 2008 in Civil Rights | Permalink Ohio Courts Network is Finally a Reality The Ohio Supreme Court has just launched the Ohio Courts Network as a new system that will eventually allow all Ohio courts and selected state agencies to share and search case-specific data. However, the Supreme Court has indicated that this system will not serve as either a case management system or case document repository, which are both functions of local court systems. Although original reviewers hoped that this system might be accessible to the public, it will only be available to authorized users from the court and justice system. The Supreme Court's justice partners include the Attorney General's Bureau of Criminal Identification and Investigation (otherwise known as BCI), the Bureau of Motor Vehicles, and the Ohio Dept. of Rehabilitation and Correction. August 13, 2008 in Court Dockets, Cuyahoga Common Pleas, Eighth District Court of Appeals, Ohio Supreme Court | Permalink Federal Courts Seeking Comments on Proposed New Rules The Federal Courts are seeking comments on proposed amendments to the Federal Rules of Appellate, Bankruptcy, Civil and Criminal Procedure. Advisory Committee reports are available for an inside look at the genesis for the changes, and the federal courts have even issued a special Memo to judges, lawyers and members of the public identifying the final date for comment submissions (February 17, 2009) and dates when hearings will be held on the proposed changes. Changes to the civil rules would affect Rules 26 and 56 pertaining to discovery of experts and the procedure for seeking summary judgment. August 13, 2008 in Federal Court, Rule Changes | Permalink Articles Explain Role and Functions of a Guardian ad Litem The Ohio Family Law Blog has posted 2 recent articles on the role and functions of a Guardian ad Litem. In Part 1 of the series, the author, Anne Shale, Esq., explains what guardians ad litem are and what they do. In Part 2, the author addresses payment of guardians and when to seek the assistance of a guardian ad litem. A key Ohio statute on guardians ad litem is contained in O.R.C. sec. 2151.281. August 08, 2008 in Children, Juvenile Court | Permalink Kahn Kleinman is Merging into Taft Stettinius Crain's Cleveland Business reports that the firm of Kahn Kleinman is merging into the law firm of Taft Stettinius, located at 200 Public Square, effective on September 1, 2008. Taft's firm name, which derives in part from former President William Howard Taft, will prevail in the new entity, which will be based in Cleveland. Crain's indicates that the new "Taft" firm will become one of the 15 largest law firms in Cleveland and will concentrate on issues involving real property,intellectual property, labor and employment law, public law, and university and school law. August 08, 2008 in Law Firms | Permalink Ohio Secretary of State Sues Over Voting Machines The Ohio Secretary of State has filed suit against Premier Election Solutions in Franklin County Common Pleas Court, alleging breach of warranty, breach of contract and fraud, in connection with problems that occurred at polls in 11 counties during the March 2008 elections. Although the Plain Dealer reports that the problem with votes being dropped was corrected when the votes were counted manually, the Secretary of State is suing for unspecified damages over what Premier claims was a conflict between its elections software and an anti-virus program. August 07, 2008 in Election Law | Permalink Paid Sick Leave May Make it to Ohio's November Ballot According to the Plain Dealer, a group called Ohioans for Healthy Families has gathered more than the required number of signatures that could put an issue on the ballot in November to guarantee full-time employees who work at companies with 25 or more workers 7 days of paid sick leave per year. Part-time employees would be entitled to pro-rated, paid sick leave. There have been a lot of articles lately about attempts by Ohio Governor Strickland to hammer out a compromise package that would not go to the voters. The Plain Dealer article indicates that select groups, including Ohioans to Protect Jobs and Fair Benefits, are concerned about the impact required, paid days off would have on Ohio employers and businesses. Interestingly, Ohio would lead the nation if sick leave becomes mandatory. August 06, 2008 in Employment Law | Permalink More Law Firms Going "Green" An article on Cleveland.com chronicles the recent efforts of law firms that are taking the ABA's challenge to go "green." Apparently,�lawyers each generate about 100,000 sheets of paper�per year, second only to the publishing industry in our production of print copy. Some of the easy efforts firms have taken to counter-act this�waste�include printing on both sides, printing on paper made from Koala food (eucalyptus trees), delivering client copies on CDs, and�posting key documents to firm intranets. Although many smaller firms are probably doing the same things, some of the leaders in the "green" movement in the legal field appear to be Porter Wright, Thompson Hine, Squire Sanders & Dempsey & Jones Day. August 06, 2008 in Environmental Law, Law Firms, Legal Profession | Permalink Lakewood Bans Pit Bulls In a vote Monday night, the Lakewood City Council has banned pitbulls. This new law, Ordinance No. 58-08, amends Section 506.12 of Lakewood's Codified ordinances. Click here to read a short article about the new local law from newsnet5.com. The last City we reported to have banned pit bulls was Garfield Heights, which did so in October of 2007.
