GCO Sues over “Man with a Gun” Incident October 4th, 2008 GCO filed a federal lawsuit in the United States District Court for the Southern District of Georgia against the Sheriff of Richmond County and a Richmond County deputy who detained a GCO member and seized his legally-carried pistol. After checking it to see whether it was stolen, the deputy confiscated the firearm until “proof of purchase” could be provided, and the Sheriff’s Department then refused to return it. The deputy insisted that it is against the law to carry a pistol openly.This sort of police misconduct is fortunately rare, but it is becoming more common as more Georgians begin carrying firearms. Posted in News | 13 Comments » GCO Appeals Airport Case September 30th, 2008 GCO has filed a notice of appeal from the September 26, 2008 judgment of the federal court in GCO’s case against the City of Atlanta regarding the City’s program of illegally searching, detaining, and arresting GFL holders for lawfully carrying firearms in the non-secure areas of the Atlanta airport. The appeal will be heard by a 3-judge panel of the U.S. Court of Appeals for the Eleventh Circuit. Posted in Hartsfield Airport's Firearm Ban, News | 5 Comments » Federal Court Dismisses Airport Case September 26th, 2008 U.S. District Judge Marvin Shoob granted the City of Atlanta’s motion for judgment on the pleadings and dismissed GCO’s lawsuit against the city over whether the city may arrest GFL holders for carrying guns in the unsecure areas of the Atlanta airport. In his order, Judge Shoob found that HB 89 does not apply to the Airport and thus state law continues to criminalize carrying a firearm in the Airport. GCO intends to appeal the order, which may be read here. Posted in News | 5 Comments » Airport Replies to Support Its Motion for Judgment on the Pleadings August 25th, 2008 Atlanta has filed a reply brief in support of its motion for judgment on the pleadings in GCO’s case seeking a declaration that no law forbids GFL holders from carrying firearms in the Atlanta airport. This motion is fully briefed and now goes to U.S. District Court Judge Marvin Shoob for a decision. The reply brief may be viewed here. Posted in News | 2 Comments » GCO Responds to Fulton County Second Motion to Dismiss August 25th, 2008 GCO has responded to Fulton County Probate Judge Pinkie Toomer’s second motion to dismiss the class action against her regarding the prohibition against nonresidents’ obtaining GFLs. The federal case seeks class certification against all probate judges in Georgia (GCO’s motion for class certification is pending). The first motion to dismiss was made moot by GCO’s amended complaint, but Judge Toomer refused to withdraw it. Last week, the federal court denied the first motion as moot. Posted in News, No issuing of Non-Resident GFL | 1 Comment » GCO Answers Airport Counterclaims August 25th, 2008 GCO has filed an answer to counterclaims from the City of Atlanta in a federal lawsuit over the legality of carrying firearms in the airport. In its counterclaims, Atlanta seeks a declaration that HB 89, the bill that decriminalized airport carry for GFL holders, is preempted by (an unspecified) federal law. The city also seeks an injunction against GCO and Rep. Bearden against carrying firearms at the airport. The documents may be viewed here. Posted in Hartsfield Airport's Firearm Ban, News | No Comments » GCO Settles With Coweta County Over Parks Ban August 25th, 2008 GCO has settled its long-standing case against Coweta County for banning firearms in county parks. GCO originally lost the case in Coweta County Superior Court, but the Court of Appeals of Georgia reversed the lower court, ruling that the county was prohibited from regulating carrying firearms “in any manner” and that it was error for the lower court to have ruled otherwise. On remand, the Superior Court granted GCO’s motion for summary judgment (in which GCO sought a declaration that the ordinance was preempted and an injunction against Coweta County from enforcing it). Coweta County repealed its ordinance and agreed to pay GCO’s attorney’s fees and costs. Posted in News | No Comments » GCO Settles with Athens-Clarke County on Parks Ban August 25th, 2008 Athens-Clarke County has followed through on its promise to repeal its ordinances regulating firearms in establishments that sell alcohol and its emergency gun store powers. These actions follow ACC’s repeal of its ordinance banning carrying firearms in parks. ACC also has reimbursed GCO for its costs in bringing a lawsuit against ACC to accomplish these repeals. GCO therefore has withdrawn its case against ACC, which now is closed. GCO applauds ACC for taking these common sense actions in the face of overwhelming legal authority against it. Posted in News | No Comments » Judge Denies Fulton Motion to Dismiss in Nonresident Case August 21st, 2008 A federal judge has denied Fulton County Probate Judge Pinkie Toomer’s first motion to dismiss GCO’s lawsuit challenging the Georgia statute prohibiting issuing GFLs to nonresidents. The motion, based on the original complaint, was dismissed as moot. Still pending is the second motion to dismiss. The judge’s order may be viewed here. Posted in News, No issuing of Non-Resident GFL | No Comments » GCO files Freedom of Information Act Request with TSA August 14th, 2008 Recently published in various media outlets was the unprecedented request by an airport (Hartsfield-Jackson) for the TSA to amend its security plan and allow the airport to ban firearms outside of the secure areas. GCO is currently in court fighting Hartsfield over its ban so we were surprised to find out that the airport is trying to create a back door way to ban firearms if their case should fail. In addition to our letter to the TSA to deny Hartsfield’s request of the security plan change, we have also asked the TSA for all the documents Atlanta submitted to the them for the request to change the security plan.
