Klicka, Esq. and William A. Estrada Senator Dole on February 24, 1995, stood before the Senate and condemned the UN Convention on the Rights of the Child. ..... He stated, Mr. President, in the past several days, I have received thousands of calls from all over the country in opposition to this Convention. My office has not received one call for it. These contacts have raised many serious problems that need to be examined. They have raised questions about Articles 13, 14, and 15, which grant children the freedom of speech, thought, conscience, religion, association, and assembly. Could these articles be interpreted to limit the ability of parents to decide for themselves how best to raise their children? Should U.S. citizens be subject to some sort of international committee that enforces compliance with Article 28(2) which states: “State Parties shall take all appropriate measures to ensure that school discipline is administered in a manner consistent with the child’s human dignity and in conformity with the present Convention?” Under Article VI of the Constitution, Senate ratification of this Treaty would make it the supreme law of the land. Would the Convention then supersede Federal and State laws? What would the effect of the convention be on the Tenth Amendment? Is the convention merely a symbolic exercise, or will it actually require the United States to take actions? These are sincere questions from sincere people. They deserve answers ... I also believe we in the United States have made significant progress in protecting the rights of the child through Federal, State, and local laws. These laws are better equipped to deal with the varying challenges posed by the issue of child rights. If there is one thing this election taught us, it is the need to get excessive government out of people’s lives. MUST SEE FULL STORY Found by AFRA Newshawk ABUSE UP FOR ACS CHILDREN By DOUGLAS MONTERO Last updated: 7:30 am July 21, 2008 Posted: 4:42 am July 21, 2008 New York Post Reports of abuse and neglect of children in city care grew by 12 percent last year, as parents, advocates and investigators keep closer watch on the municipal government's long-troubled child-welfare system. The number of abuse complaints against foster parents and others asked by the Administration for Children's Services to look after troubled youngsters grew to 1,708 in the 2007 fiscal year, up from 1,525 in 2006, city records show. In one such case, Florida resident Judith Leekin, 63, was sentenced to 11 years in prison last week for taking more than $1.6 million from ACS even as she abused 11 disabled kids left in her care when she lived in Queens. Abuse complaints involving foster parents and other caretakers are investigated by the ACS Office of Special Investigations, an internal affairs unit that was revamped two years ago. Which seems to have disappeared already. Some 362 of the abuse cases reported in 2007 were substantiated by ACS investigators, meaning that there was enough evidence to take corrective action or forward information about the cases to district attorneys' offices for prosecution, city records show. Last year's tally of abuse cases showed that 11 kids in city care were sexually abused, 66 were beaten and one endured psychological abuse. ACS officials say they have a tough job dealing with abuse by people hired to care for children, and note that with 8,000 foster parents in the city caring for 17,000 kids, the rate of substantiated cases is tiny. If it was the same "investigation" as real parents get, the substantiation rate would be MUCH higher. Andrew White, who runs the watchdog group Child Welfare Watch, said the rise in abuse complaints is due to the retooling of the Office of Special Investigations, including the hiring of 60 former law-enforcement officers. "It shows a higher sense of caution and a more rigorous and intense approach to investigating," he said. But another advocate says greater vigilance by parents angry that their children were unjustly taken has sparked the rise in abuse complaints against ACS. "Parents have become more outspoken about the abuse of their children. People are fighting back," said Rolando Bini, who heads Parents in Action, a grass-roots group. Barack Obama to a campaign volunteer asking for her support of the presidential candidate. Two federal agents arrived at Jessica Hughes' home Thursday to ask her if she said, "I will never support Obama and he will wind up dead on a hospital floor." Hughes said her words were deliberately twisted by a volunteer who was apparently unhappy Hughes was rude during a phone conversation the two had. The Lufkin mother, a Republican, said she received a call on her cell phone Wednesday from a woman with the Obama Volunteers of Texarkana. "She asked if I was an Obama supporter, to which I replied, 'No, I don't support him. Your guy is a socialist who voted four times in the state Senate to let little babies die in hospital closets; I think you should find something better to do with your time.' (And then) I hung up." ....Hughes said she was surprised to see two Secret Service agents at her door, and upset to learn that the conversation she had with the volunteer apparently had not been recorded. ...."I find it hard to believe that (campaign volunteers) don't tape these calls. They call people unsolicited and they aren't monitoring the calls or recording them? I think that is absolutely ridiculous," she said. "I mean, how often must this happen — that someone is rude to a volunteer that they don't want to talk to?" Hughes said she wants to file a countercomplaint against the volunteer. "She has made a charge that will follow me the rest of my life," she said. "I find that repugnant and violating — that some person who got her undies in a bundle because she didn't like what I had to say." Tue, Oct. 07, 2008 Critics contend Kansas county too quick to take kids By ROXANA HEGEMAN Associated Press Writer WICHITA, Kan. _ When a local middle school mistakenly reported a 13-year-old home-schooler to the state as a truant, it seems like the matter could have been easily cleared up. Instead, Ashton Baker ended up in the Wichita Children's Home, having been dragged into the state child-welfare system in a county that critics contend is one of the most likely places in the U.S. to take children from their parents. Along the way, Ashton's mother, Bambi Baker-Hazen, missed a court hearing, which she says she never received notice of, (absolutely normal CPS technique) and her ex-husband was given temporary custody of their daughter. After Ashton ran back to her mother's house, police arrested the girl as a runaway. A judge subsequently found a lack of supervision at the mother's house and ordered Ashton placed in the Wichita Children's Home, although Baker-Hazen still has custody of her three other children — ages 6, 8 and 16. The girl ran away from the home on Monday and was still missing Tuesday, according to her mother. Baker-Hazen contends that the Kansas Department of Social and Rehabilitative Services misled the court when it said it made reasonable efforts to keep her family together. The department and the local district attorney's office won't discuss the case, citing privacy laws, but Baker-Hazen produced documents confirming that truancy was the reason for the department's involvement. Her allegations aren't unusual in Sedgwick County. While the state agency says it complies with all federal rules, the National Coalition for Child Protection Reform claims that the department is evading requirements that reasonable efforts be made to keep children out of foster care and that it is underreporting cases to a central federal database. Critics contend officials in Sedgwick County are overreacting to some high-profile child abuse cases, such as a 2006 one involving two Wichita children allegedly starved, beaten and tortured by their father and stepmother. Advocacy groups and angry parents have pointed to comments from the head of the state agency, Don Jordan, who indicated in March that his case workers felt pressured by the Sedgwick County district attorney's office to include false information in court documents to ensure children are removed from homes. Sue Jackson, AFRA Director With teens being left at hospitals, Nebraska Legislature sets hearing By Jim Kavanagh CNN 10-8-08 (CNN) -- Frustrated parents are dumping their teenagers at Nebraska hospitals -- even crossing state lines to do it -- and the state Legislature has scheduled a special hearing to try to stem the tide. Nebraska's "safe haven" law, intended to allow parents to anonymously hand over an infant to a hospital without being prosecuted, isn't working out as planned. Of the 17 children relinquished since the law took effect in July, only four are younger than 10 -- and all four are among the nine siblings abandoned by a man September 24 at an Omaha hospital. On Tuesday, a 14-year-old girl from Council Bluffs, Iowa, was abandoned at Creighton University Medical Center in Omaha, Nebraska, just across the Missouri River from Council Bluffs. The case marks the first time a parent has crossed state lines to abandon a teenager in Nebraska, authorities said. "The few situations we've seen so far demonstrate the need for a change in Nebraska's safe haven law," Gov. Dave Heineman said in a statement Monday. "In the coming legislative session, I will advocate for changes that put the focus back on protecting an infant in danger. That should be our priority." All 50 states have safe haven laws, but only Nebraska's lacks an age limit. Nebraska's part-time Legislature is adjourned until January, but two state legislative committees will hold a joint hearing November 13 to discuss a remedy. "They've got a huge problem," said Linda Spears, vice president for policy and public affairs for the Child Welfare League of America. "It's a pretty poorly constructed law to meet its original intent." ..."Clearly in these cases so far that we've seen, none of these children were in any immediate danger of being harmed," Landry said. "It is our opinion that the law does need to be modified." CPS wouldn't see it that way. These teens are a dangerous liability to drag the family into the talons of CPS for destruction. And CPS goes in blindly swinging the axe. The law is being abused, Heineman's statement said. "Safe haven laws were not designed to allow families having difficulty with older youth and teenagers to abandon their children or responsibilities (read LIABILITY) as parents," he said. The parents may not always be to blame, the Child Welfare League's Spears said. "The original safe haven laws were created for young moms who are having babies who didn't know how to get help. I think these are families with older kids who don't know how to get help and who are in desperate need," she said. ...A woman who dropped her 15-year-old nephew at a Lincoln, Nebraska, hospital told CNN affiliate KETV last month that she and the boy's guardian could no longer handle his behavior problems. The woman, Cathy Poulin, said she tried discipline and medication, but nothing worked. The boy's mother died several years ago, and his father left him, she said. Bush signed into law the Orwellian-named Fostering Connections to Success and Increasing Adoptions Act. This communist legislation passed by unanimous consent in the House on September 17, thanks to the "leadership" of "Representatives" Jim McDermott (D-WA) and Jerry Weller (R-IL) and in the Senate on September 22, due to the misguided efforts of Senators Chuck Grassley (R-IA), Max Baucus (D-MT) and Jay Rockefeller (D-WV). The new law represents the most grievous addition to the nation's foster care system since the fascist ASFA of 1997. As a result of the Fostering Connections to Success and Increasing Adoptions Act, millions more children will be kidnapped, denied their Constitutional Rights and be made legal orphans. The Fostering Connections to Success and Improved Adoptions Act includes the following provisions: - Incentives to increase adoptions of children from foster care, especially older youth and those with "special needs". Translation- dope them out of their skulls and collect their Social Security. - Phased elimination of an outdated eligibility requirement for adoption assistance that will increase the number of special needs children who can be adopted with federal support. Translation- Build a bigger hog trough and they will come. - Federal resources to assist children who leave foster care for legal guardianships with family members. Maybe. But since that's what the LAW said was supposed to happen all along, perhaps greasing the path with $$ will get more kids back with real family.  - Direct federal foster care funding for tribal governments, so that more American Indian and Alaskan Native children can receive the supports and services they need while remaining in their own communities. Translation- Build a bigger hog trough and give CPS an excuse to invade the reservations. - Allowing states to provide foster care supports and services to young people up to age 21. Translation- Collect their Social Security for three more years before dumping them on the street with no education, no skills. - Improved oversight of educational progress and health care needs of children while in foster care. What a concept. Think that's going to happen? - Mandating that "reasonable efforts" be made to place siblings together when they enter the foster care system. The 21-page suit seeking at least $50,000 in compensation was filed Wednesday by lawyers for the Family Defense Center, a not-for-profit organization based in Chicago that represents parents against the child welfare system. The lawsuit charges that authorities "tore a healthy and happy toddler from her innocent parents." Then, it alleges, child welfare investigators "held the toddler hostage until the parents agreed to forfeit their constitutional rights to live without unwarranted restrictions." A spokesman with the Illinois Department of Children and Family Services said the agency does not comment on pending litigation. On Sept. 17, 2006, Nataleigh Evans took a tumble while learning to walk and hit her head on a coffee table, the lawsuit said. When a red bump appeared, her mother, Jennifer Evans, took her to a pediatrician who made an allegation of abuse to the DCFS hot line. Two child welfare investigators and two Tinley Park police officers visited the Evans home and found her "safe and well-cared for," the lawsuit said. Days later, DCFS social workers took the child from her parents for several hours. The social workers then, according to the suit, threatened the parents with the continued custody of their daughter and placement in a shelter "unless they signed a so-called safety plan restricting their custodial rights." ocasillas@tribune.com Absolutely normal CPS operation.
